CUSTOM PRINT DESIGN SERVICE AGREEMENT

This Agreement outlines the terms under which Britt LaSpina (“Designer”) provides custom print design services to the Client.

GST is not charged on international transactions where applicable.
No rights are granted until full payment has been received.

The Designer retains full copyright ownership of all artwork created.
Upon full payment, the Client is granted an Exclusive, Commercial Licence - non-transferable to use the final approved design for their brand.

Timelines are estimates and depend on client communication and project scope. The Designer is not liable for delays outside their control.
9. Refunds

To the maximum extent permitted by law, the Designer’s liability is limited to the total fees paid for the project.
11. Governing Law
This Agreement is governed by the laws of Queensland, Australia. The parties submit to the exclusive jurisdiction of the courts of Queensland.
12. Acceptance of Terms
By making payment, approving work, or proceeding with the project, the Client confirms acceptance of these Terms & Conditions and enters into a legally binding agreement.

The Client acknowledges that the Designer operates in Australia (AEST) and response times may reflect time zone differences.

2. Scope of Services
The Designer will provide:
- 1 x Custom Print & Textile Design
- High-resolution artwork
- Seamless repeat file
- Delivered digitally via Dropbox
3. Revisions
The project includes:
- 1 round of revisions
- Up to 4 motif changes within that round
4. Fees & Payment
- A 50% non-refundable deposit is required to commence work
- The remaining 50% must be paid prior to final file delivery
- No files will be released until full payment is received

- Use in marketing and promotional materials
- Resell, sublicense, or distribute the artwork as a standalone design
- Use the artwork for print-on-demand, digital resale, or stock platforms
- Transfer the licence to another brand or entity
- All preliminary concepts
- Sketches and working files
- Unused or rejected designs
6. Portfolio & Promotional Use
The Client agrees that the Designer may:
- Use the final artwork
- Share product imagery (supplied or publicly available)
- Display the work across website, portfolio, social media, and marketing
7. Client Responsibilities
The Client agrees to:
- Provide clear direction and feedback
- Respond in a timely manner
- Ensure they hold rights to any materials supplied
- Credit @brittlaspinadesign where reasonably possible when sharing behind-the-scenes content.
